PUBLIC AUTO AUCTION RULES
1. General Rules: 1.1 Auction Participation
- The auction is open to the public. However, all participants must be at least 18 years of age to register and participate.
- Registration is required to bid. Participants must provide valid identification (e.g., driver’s license) at the time of registration.
- A bidder number will be assigned after registration.
1.2 Auction
- All vehicles will be sold to the highest bidder. The auctioneer's decision is final.
- Each vehicle will be auctioned in the order listed in the catalog or as announced by the auctioneer.
- Bidding increments will be set by the auctioneer and are subject to change based on the bidding activity.
2. Vehicle Inspection: 2.1 Pre-Auction Inspection
- All vehicles will be available for inspection during the designated preview times prior to the auction.
- Buyers are strongly encouraged to inspect vehicles thoroughly before bidding.
- The auction is not responsible for any defects or damages in the vehicles. All vehicles are sold "AS-IS" with no warranties.
2.2 Condition of Vehicles
- The auction house will make every effort to provide accurate descriptions of the vehicles; however, no guarantees are made regarding their condition, mileage, or any other features.
- It is the responsibility of the bidder to assess the vehicle’s condition.
3. Bidding Process: 3.1 How to Bid
- To place a bid, raise your bidder number card clearly or follow the auctioneer’s instructions.
- Bids must be made in whole dollar amounts unless otherwise directed by the auctioneer.
- Once a bid is accepted, it cannot be retracted.
3.2 Winning Bid
- The highest bid at the call of the auctioneer’s last call will be the winning bid.
- The auctioneer’s decision is final, and any disputes regarding the final bid will be resolved by the auctioneer.
4. Payment: 4.1 Payment Terms
- Payment must be made immediately following the auction, or as directed by the auctioneer.
- Accepted payment methods include cash, certified check, or credit card (subject to auction house approval).
4.3 Failure to Pay
- Failure to complete payment within the prescribed time will result in forfeiting the vehicle and the deposit $250. The vehicle will be re-auctioned, and the bidder may be banned from future participation.
5. Title Transfer and Fees: 5.1 Title Transfer
- Title transfer will occur only after full payment has been made.
- All buyers are responsible for title transfer, taxes, and fees associated with the vehicle’s registration.
5.2 Taxes and Fees
- Applicable taxes, licensing, registration fees, and title transfer costs are the responsibility of the buyer.
- All fees will be calculated based on the final sale price of the vehicle.
6. Auction Day Conduct: 6.1 Conduct During the Auction
- Bidders are expected to maintain appropriate behavior and respect the auction process.
- Disruptive behavior, including loud comments, harassment, or interfering with the auctioneer, will not be tolerated and may result in removal from the event.
- No one may place bids on behalf of another person without proper authorization.
6.2 Safety and Behavior
- Participants must remain in the designated areas.
- The auction house reserves the right to remove anyone from the premises who is disruptive or violates auction rules.
- No animals of any kind are permitted in the viewing area for any reason.
- No paraphernalia, drugs, or alcohol are permitted on the premises.
- Failure to follow these rules will result in being asked to leave the premises and may result in being banned from participating in future auctions.
7. Liability: 7.1 Limitation of Liability
- The auction house is not responsible for any damages, theft, or loss of personal property during the auction.
- The auction is not responsible for any errors or omissions in the vehicle descriptions.
- Buyers assume all risks associated with the vehicles once they are sold.
8. Additional Terms: 8.1 Changes to Auction Rules
- The auction house reserves the right to amend or add to these rules at any time without prior notice.
- Any amendments or changes will be posted in a timely manner.
8.2 Dispute Resolution
- Any disputes or claims arising from the auction will be handled according to the laws of [State or Jurisdiction].
This is an “AS IS Auction”, we do everything in our power to list the
cars condition accurately and highlight the major flaws in advance on
the site. All vehicles sold as is how is, where is.
It is the buyers’ responsibility to review and judge vehicle condition
before bidding.
